- Building permit :
It is an authorization for the construction or the transformation of a construction whatever its implantation.
- Content :
- Location plan to scale 1/2000 or 1/5000 ;
- Ground plan of the construction and development to scale 1/200 or 1/500 ;
- Project plans to scale 1/50 :
- Interior distribution of the different levels of the construction with the networks of : drinking water supply, sewage, electricity and heating ;
- Frontages including fences ;
- Useful sections ;
- Plans of terraces.
- Civil engineering studies ;
- All trades:
- Electricity, gas ;
- Drinking water supply ;
- Sewage ;
- Carpentry ;
- Heating and air conditioning.
- The written and graphic documents describing the construction by phases.
In case there is a completed construction that is not provided with a building permit, and according to article 21 of the law n° 08-15 dated July 20, 2008, the following documents must be provided:
- Written and graphic documents and civil engineering plans of the construction as completed, established jointly by an architect and a civil engineering engineer.
- A descriptive statement of the works that have been carried out.
- Photos of the frontages and the outer spaces.
Documents pertaining to the architectural design and to civil engineering studies must be stamped by the architect and the civil engineer.
- Submission:
The APC (Communal People's Assembly) of the place of the implantation of the construction (5 copies).
- Time limit of issuing :
- 3 months, by the P/APC (The president of the Communal People's Assembly), when there is a land use plan: for the projects that do not fall under the wali and the minister competence.
- 4 months, by the P/APC, when there is no land use plan: for the projects that do not fall under the wali and the minister competence.
- 4 months, by the wali, for the constructions and facilities that have been achieved on behalf of the state and the wilaya.
- 4 months, by the minister in charge of town planning, for structuring projects of national or regional interest.
The building permit is not granted if the construction does not comply with the prescriptions of the subdivision permit.
When the building permit is delivered for the achievement of one or many constructions in one or many phases, it becomes null and void if the phase has not been completed within the time limit prescribed by the ordinance on the building permit.
- Respite:
Maximum: 1 year, if the instruments of development and town planning are under elaboration.
2 - Certificate of compliance:
It is an administrative deed issued at the completion of the works, in accordance with the clauses of the building permit.
It is also an administrative document issued to the builder after the completion of the works. It ascertains that they comply with the building permit and town planning rules.
The certificate of compliance must not only focus on the construction itself but on the works and the elements of the equipments that are necessary to the use of the building as well.
The certificate of compliance is considered as an authorization to occupy the premises, i.e. to live or to receive people.
- Content:
A declaration hat is submitted 30 days with effect from the completion of the works.
- Submission :
APC of the place of the implantation of the completed work.
- Time limit of issuing:
- 3 months, by the P/APC for the projects that fall within his competence.
- 3 months, by the wali for the projects that fall within his competence and that of the minister.
In case the works have not been carried out in accordance with the approved plans and with the clauses of the building permit, the person concerned has to undertake the compliance of the construction with the approved plans.
- 2. Demolition permit:
The demolition permit is an authorization prior to any operation of a partial or total demolition of a building.
- Content:
The building permit application is expressed and signed by the owner of the building to be demolished, his proxy or the specialized department or public organization that has to supply:
Written documents:
- A copy of the ownership deed,
- A mandate,
- A copy of the administrative deed that has established the allocation of the building.
Graphic documents:
- A location plan to scale 1/2000 or 1/5000 ,
- The ground plan to scale 1/500 of the construction that is to be demolished or to be preserved in case there is a partial demolition,
- A detailed study on the reasons of the planned operation,
- Data on the conditions of the present use and occupation,
- The nature of the demolition works ,
- The possible allocation of the vacant site,
- A technical expertise that specifies the conditions of the planned demolition.
- Submission:
The application of the demolition permit is submitted in 5 copies to the P/APC of the place where the construction is implanted.
- Time limit of issuing:
The demolition permit is issued in the form of an ordinance. The applicant can start the works 20 days after the date of obtaining the demolition permit and after having established a declaration to open a building site.
The building permit is null and void if:
- The demolition has not occurred after 5 years,
- The demolition works have been suspended for 3 consecutive years,
It is cancelled by a justice decision.
